You may have your benefits reinstated anytime during the 500 weeks following the date that your benefits were suspended. In other words, you may petition to reinstate within 500 weeks from the last date of a workers’ compensation payment. If at the end of the 500 week period you are receiving partial disability benefits, then your entitlement to partial disability benefits stops and you have three years after the last compensation payment to file to reinstate wage loss benefits. If you have been receiving partial benefits and the partial benefits have not exceeded the 500 weeks maximum allowable partial payments under the Pa. Workers’ Compensation Act, then you may file a petition to reinstate your benefits to total disability benefits.
